PLEASE NOTE: This site is directed solely to those eighteen (18) and older. All purchases through this site are assumed to have been made by those over the age of eighteen (18). No refunds will be given for transactions initiated by those under the age of eighteen (18) who may use this site under false pretenses.

DEFINITIONS OF TERMS USED

The www.bhpub.com domain name is owned by Chris, and is currently hosting Lasting Impressions by Chris which is the prior incarnation of Studio|chris. At the entire completion of the studiochris.us website, the bhpub.com domain name will only be used to redirect to the main Studio|chris site.
Visitor, User or customer - Both refer to those who are using this site, be they visitors or paying clients.
Services - Any service listed as available on this site, including but not limited to any of the following services or combinations of services. (graphic art commission, graphic modification, graphic conversion, advertising design, logo design, photo re-touch, visual art commission, digital painting commission, creation of digital art, creation of physical art, creation of documents in any form, design of documents in any form, document layout, document analyzation, document format conversion, web site design, web site customization, web site layout, availability of web site templates...)
Products - Any final product of any service or combination of services included within this site. Final products include but are not limited to web design templates, document design templates, graphics commissioned through this site, etc.

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States and/or the country in which you reside.

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service(s) or Product(s) of this site, use of said Service(s) or Product(s), or access to the Service(s) or Product(s).

Any final product or service that is listed within any of these categories remains copyrighted to Chris Price and Studio|chris unless the customer purchases exclusive/limited rights. Merely purchasing a service or product does not grant any rights of outside of any agreement between you and Studio|chris. If you have regarding the copyright status of any product or service offered by Studio|chris, please contact Chris. Other terms may apply to certain products listed on this site. Those additional terms will be provided with the end product.

PRICING
All prices in this site are listed and charged in US Dollars (USD). International exchange rates change by the second. For an approximate exchange rate, you may visit http://www.xe.com, which is not affiliated with Studio|chris in any way . Any weight measurements that may be listed with products are estimated. Shipping charges are calculated interactively on a per-order basis by the United States Postal Service.

SALES TAX
All orders purchased within or shipped to the state of South Carolina are subject to South Carolina sales tax. Orders placed on or before May 31, 2007 will be charged 5% sales tax on all tangible goods. Orders placed on or after June 1, 2007 will be subject to South Carolina's new sales tax rate of 6% on all tangible goods.

METHOD OF PAYMENT
All purchases via online payment for this site are processed through an external payment processor known as PayPal®. Please visit their site for their terms and conditions of using the service they provide. All International purchases must be made via PayPal.

Studio|chris also accepts US Money orders and personal checks from within the United States. Please allow up to 10 days for checks to clear and orders to be processed. Orders will not ship until all checks have cleared. All returned checks are subject to a $35.00 service fee.

PAYMENT SCHEDULE
Studio|chris requires prepayment for products and services. Prior to beginning any custom project, Studio|chris requires a non-refundable retainer fee based upon the final quoted price of the work to be completed. The fee schedule is as follows:

Studio|chris, in its sole discretion, reserves the right to modify the retainer fee schedule on a case by case basis.

Before any final product is delivered, 100% of Studio|chris' fee(s) must be paid.

RIGHT TO REFUSE
Studio|chris reserves the right in its sole discretion to refuse service at any time. Sale of any product or service is subject to availability.

REFUND/RETURN POLICY
Fine Art Prints - If any print arrives damaged, Studio|chris will gladly replace the item within 15 days. If the item is no longer in stock, we will replace it with an item of equal value or a gift certificate of equal value. Undamaged prints may be returned within 15 days of purchase for a full refund. Client is responsible for any return shipping charges.

CD/DVD-ROMs - Unopened CD & DVD-ROMs may be returned to Studio|chris within 15 days of purchase for a full refund. Opened CD & DVD-ROMS, if damaged upon receipt, may only be exchanged for an undamaged copy of the original item purchased. Client is responsible for any return shipping charges.

Non-tangible and Custom Items - Due to their nature, services, digital downloads, gift certificates, one of a kind items, custom items, personal portraits and all non-tangible products are NOT refundable for any reason after purchase or after work has begun. If a tangible item is received damaged, Studio|chris will gladly replace the item within 15 days. Client is responsible for any return shipping charges.

Items eligible for refund that are purchased by using a gift certificate will be refunded to a new gift certificate in the amount of the original purchase minus any applicable shipping charges.

UPDATES TO THE TERMS OF THIS SITE
Studio|chris may provide you with notices, including those regarding changes to these policies, by e-mail or prominent postings on the Site.

FINAL STATEMENTS
Simply using and interacting with/on this site is an admission and acceptance of these terms without recourse. You agree to indemnify and hold Studio|chris, this site and its officers, agents, affiliates or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising from Content you view, submit, post to or transmit through this site, your use of the site, your connection to the site, your violation of the agreement, or your violation of any rights of another or vice versa.
